3. Site Activity

On the web shop HEAVEN Budapest sells fashion products for both men and women. In addition to clothing, you will find multiple accessories, such as bags, shoes, belts, caps and so on. Orders placed on the web shop will be delivered via a courier company. All products are delivered from stock. Regarding shipping and delivery please refer to the Shipping & Returns Policy page.

4. Term of Use


All users use the web site entirely at their own risk, while accepting that the service provider does not take any responsibility for any material and non-material damages that may occur. In addition, the provider is not liable to the users for any loss or corruption of data, loss or damage to their computer equipment, or any loss, damage suffered by them as a result of their negligence that may result in personal injury. The provider disclaims all responsibility for the behavior of the users who are fully and solely liable for their own actions. The user must ensure that while using the website it does not harm directly or indirectly any third parties rights nor the legislation.

5. Shopping on the Web Site

  1. The Ordering Process

On the website we provide product presentation and online ordering services for our users. The users are allowed to browse with the help of the menu options. The products are sorted into categories. All products that are on sale, can be found in the web shop as well, and they are sorted into a highlighted category. At every product, both the original and the discounted price is posted.

As the user clicks on a certain category, all items included in it will be shown. If all the items in the category don’t fit into one page, the user should scroll down to the bottom of the page and click on the numbers to turn to the next page. The user can gain a detailed information about a product either by clicking on a product and looking at it in a quick view or on the products data sheet. On the website users have the possibility to search according to name, colour and price. Upon selecting the colour and quantity of the chosen item, it can be placed into the shopping bag by clicking on the bag button. The contents of the shopping bag can be checked under the bag title, where you can modify the colour, quantity of your order, while being able to completely remove it from your bag. You can continue with your order by clicking on proceed to checkout button. If you are not logged in yet, but are already a registered user, you will be able to sign in, at the appearing window. In our web shop, only registered users are allowed to place orders. Upon registration, the user must provide the following information : name, gender, date of birth, address, e-mail address, telephone number. In addition, the user is required to enter a password. If the registration was successful, the user will receive a confirmation e-mail. The user can request the cancellation of the registration from the service provider, though in case they wish to shop again they must register again. For the confidentiality of the user name and password, the user is responsible. The user is also responsible for updating their information, and must report to the service provider if they become aware that a third party has accessed their information. In case, the user forgets their password, they may request a new password to be sent to their registered e-mail address. The shopping can be resumed after logging in with the previously registered user name and password. The user has the possibility to check all the information they have previously entered, along with the quantities and products selected on a summary page. On the summary page, the user can modify all the information they have entered and to write comments regarding order and delivery. Next you can select the payment method, which is by credit card only. Upon accepting and agreeing with our terms & conditions, you may finalise your order by hitting the submit button. You will receive a confirmation both on the website and in e-mail. In case, the user notices an error after the confirmation of the order, they must report it immediately to the service provider. Regardless of the users shopping intentions, they may log in, under the sign in button. After signing in, under the Profile button, the users have the possibility to modify all information they have previously entered.

  2. Confirmation

The users must receive the confirmation of the order, within 48 hours. In case, they do not receive the confirmation e-mail within that time frame, they are not obliged to accept the delivery, as they are exempted from the contract.

The confirmation e-mail contains all the information provided during the ordering process, such as the name of the item, its price, quantity, payment method, shipping costs, order number, and the users comments regarding the order.

  3. Invoice

Upon the fulfillment of the order, the service provider issues a paper based, VAT included invoice, which is in the package delivered by the courier.

The invoice does not qualify for further resale of the products.

  4. Payment

All payments are by credit card only. After submitting your order, the system will automatically redirect you to a surface where you can submit your credit card information. We accept Visa, EuroCard/MasterCard credit cards. We never gain access to your credit card information, we only get a notification whether the transaction was successful or not. If the transaction was successful, then our colleagues will receive your order. About this you will get an e-mail confirmation. If you don’t receive the e-mail confirmation within 10 minutes, check your spam folder or contact us by phone. For the payment you need to submit your credit card number, the expiry date and the last 3 digits of the verification number on the back. If you have filled in all the information, the payment is complete after pressing the submit order button. Then, the financial institution checks the data entered by the user and if everything is correct, the amount is deducted from the purchaser’s card. Both the successful and unsuccessful transactions are displayed by the system, which then gives the user the option to step back to the web shop’s home page. You have to click on the link offered by the system, to continue. The credit card payment goes through a closed, encrypted system provided by the bank. The service provider states that based on their contract with the bank, they are liable for keeping all the information confidential and will not give it to any third parties. The general terms & conditions for paying with credit cards apply to credit card purchases in our web shop. The safety, encryption of the information and the proper transaction of the payment is ensured and carried out by the bank. The provider is informed by the bank about the outcome of the transaction. Therefore the service provider does not take responsibility for payment related issues. The user is responsible for providing real information and is required to use the service properly, according to the terms & conditions. The bank is entitled to immediately suspend the transaction in suspect of fraudulent activity. The service provider does not revise the bank’s decision whether the transaction was successful, unsuccessful or fraudulent. The provider has the right to make claims from the customer in case of a transaction that was qualified as a fraudulent by the bank. The service provider shall not liable if the internet connection is lost, therefore the transaction is not completed or failed.

During the credit card payment the user consents to the following: I accept, that my personal information stored in the www.retrojeans.com database by AtlanticOne Incorporated Ltd. ( 1107 Budapest, Fogado street 4. ), is transferred to PayU Hungary Ltd. ( 1074 Budapest, Rakoczi ut 70-72. ), who act as data manager. The following information is transferred : login name, last name, first name, country, phone number, e-mail address.

The purpose of the data transferring: customer service assistance, transaction confirmations, fraud-monitoring.

  5. Shipping

HEAVEN Budapest works with DPD courier services. DPD ships the ordered products on business days, from Monday - Friday, between 8am - 5pm. On the day of the shipping, you will receive a short notice ( via text message, e-mail ) about the pickup of your package ( your package has left our central warehouse ) and about the next day delivery ( in case of international orders, 2 - 5 business days ). The courier delivers the package on business days, between the time slot indicated on the short notice. In case you are not present when the delivery comes, the courier will leave a notice at the given address. Using the number listed on the notice, go to the www.dpd.hu website, so you can have the package delivered according to your individual preference. You can also modify the delivery address, or delivery date. However, you also have the possibility to modify the delivery date via telephone. The delivery of the package is attempted two times, afterwards you have to re-pay the shipping costs in order to receive the package. Prior to receiving the package, please make sure there is no damage on the packaging. Upon delivery you have to verify that you have received the package with your name, date and signature.

Upon picking up your package, the courier service e-mails you the tracking number belonging to your package, so you can track your order. To do so, you have to go to the www.dpd.hu website and type in your tracking number in the up right corner search field.

The provider - unless stated otherwise - is required to deliver the products no later than 30 days, after entering into a contract with the user. In case the provider is late, the user has the right to set an additional deadline. If the provider does not ship the product within the additional period, the user has the right to terminate the contract.

6. Right of Withdrawal

  1. The Withdrawal process

The points mentioned below only apply to those, who buy, order and receive the goods for their own personal use ( the consumer ) and will not distribute nor use them for any business related purposes. From the date of receipt of the product, the consumer has the right of withdrawal for fourteen ( 14 ) days, without giving any reason. The consumer can also exercise the right of withdrawal between the date the the contract was made and the date of delivery. If a consumer wishes to exercise their right of withdrawal, they must notify the service provider via the e-mail address or telephone number mentioned in section 1. of the terms & conditions. The consumer can exercise their right of withdrawal if they notify the provider before the above mentioned deadline. The consumer is liable for proving that they exercised their right of withdrawal according to section 5. In both cases, upon the receipt of the withdrawal notice, the provider will immediately confirm it. The withdrawal should be considered valid, if the provider has received an electronic note from the consumer within 14 calendar days. In case of withdrawal, the consumer is required to ship the products to the address of the provider’s central warehouse ( 2364 Ócsa, Székesmajor HRSZ 0121/11 ), within 14 days, counting form the day the cancellation was notified. No delays are accepted! The deadline is considered to be kept, if the product is received before the 14 days period. The shipping costs of the return weigh the consumer. In addition to the shipping costs, the consumer is not liable for any other fees. As the consumer withdraws from the contract, they must fulfil all the services required by the provider, within the 14 day period, including the shipping costs. The provider is entitled to withhold the refund as long as they have not received the product or consumer has not proved clearly that they have shipped it back. In all cases, the refund will be transferred to the account number that was given by the consumer. After receiving the withdrawal notice, the provider will contact the consumer, to discuss the withdrawal procedure and its details. The user shall be liable for any damage, depreciation to the product, that occurred due to not properly using the item.

In case of a verbal complaint, the provider will try to solve the problem ASAP. If there is no possibility for verbal complaint, a written complaint should be sent to the provider’s e-mail address, which is mentioned above. The service provider will answer the e-mail within 30 days. In case of rejection of the complaint, the provider will inform the user about the rejection’s reason. In case the provider and the user cannot come to a mutual agreement, the interference of a local Conciliation Board may be indicated.


9. Other

9.1. Terms & Conditions, Price Changes

The service provider may modify the terms & conditions at any time, and also the prices of the products on the website. The modifications will take effect upon publishing the changes on the website, and will apply to all transactions. Despite of all supervision over the web shop prices, it may happen that a product gets a wrong price label due to system errors. In these cases, when the product is obviously not priced correctly, such as selling for €0 or €1 the provider does not take liability and is not obliged to sell for the wrong price. The provider will offer the user to buy the product at the correct price or the cancellation of the purchase.
